Terms and Conditions for Accommodation Contracts

Scope of Application

Article 1.
1. Contract for Accommodation and related agreements to be entered into between Kanazawa Tamaruya (“Hotel”) and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided for herein shall be governed by laws and regulations and/or generally accepted practices.
2. The Hotel does not provide any services other than accommodation.

Application for Accommodation Contracts

Article 2.
1. A Guest who intends to apply for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:

  1. ) Name of the Guest(s), address, phone number (or mobile phone number) and nationality
  2. ) Date of accommodation and estimated time of arrival;
  3. ) Number of the Guests
  4. ) Other particulars deemed necessary by the Hotel.

2. In the case where the Guest requests, during the stay, an extension of the accommodation beyond the date in Particular 2 of the preceding paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Conclusion of Accommodation Contracts, etc.

Article 3.
1. A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article, and accepted an accommodation deposit by the date specified by the hotel. However, the contract shall not be deemed to have been concluded if it has been proved that the Hotel has not accepted the application.
2. When the Guest has failed to pay the deposit by the date required as stipulated in the preceding paragraph, the Hotel shall treat the Accommodation Contract as invalid.

Refusal of Accommodation Contracts

Article 4.
The Hotel shall have the right not to conclude an Accommodation Contract under any of the following cases:

  1. ) When the application for accommodation does not conform to the provisions of these Terms and Conditions;
  2. ) When the Hotel is fully booked and no room is available;
  3. ) When the Guest seeking accommodation is deemed liable to conduct himself in a manner that would contravene the laws or act against the public order or good morals in regard to the accommodation;
  4. ) When a person seeking accommodation is under any of the following cases;
    1. A member of organized crime group as provided in Article 2 Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (“an Organized Crime Group”), a member of an Organized Crime Group as provided in Article 2 Paragraph 6 of the same Act (“a member of an Organized Crime Group”), an associate member of such groups or person who is concerned with such groups or other anti-social forces.
    2. A corporation or other entity whose business activities are controlled by an Organized Crime Group or a member of an Organized Crime Group
    3. A corporation whose directors include persons corresponding to a member of an Organized Crime Group
  5. ) When the Guest seeking accommodation is clearly determined to be carrying an infectious disease;
  6. ) When the Hotel receives demands in a violent fashion or is requested to assume an unreasonable burden with regard to the Guest’s accommodations.
  7. ) When the Hotel is unable to provide accommodation due to natural calamities, the malfunction of the facilities and/or other unavoidable causes;
  8. ) When a person seeking Hotel accommodation is applicable to the provisions of Ishikawa Prefecture Hotel and Ryokan Management Law, Article 12.

Right to Cancel Accommodation Contracts by the Guest

Article 5.
1. The Guest is entitled to cancel the Accommodation Contract by so notifying the Hotel.
2. In the case where the Guest has canceled an Accommodation Contract in whole or in part due to a cause for which the Guest is liable, the Guest shall pay cancellation charges in accordance with the following rule.

  1. ) Cancellation 14 days to 8 days before the day of check-in: 50% of the room charge
  2. ) Cancellation during the week before check-in or no-show: 100% of the room charge

Right to Cancel Accommodation Contracts by the Hotel

Article 6.
1. The Hotel may refuse the conclusion or an extension of the Accommodation Contract under any of the following cases:

  1. ) When the Guest is deemed liable to conduct or has conducted him/herself in a manner that would contravene the laws or act against the public order and good morals in regard to the accommodation;
  2. ) When a person seeking accommodation is under any of the following cases;
    1. A member of organized crime group as provided in Article 2 Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (“an Organized Crime Group”), a member of an Organized Crime Group as provided in Article 2 Paragraph 6 of the same Act (“a member of an Organized Crime Group”), an associate member of such groups or person who is concerned with such groups or other anti-social forces.
    2. A corporation or other entity whose business activities are controlled by an Organized Crime Group or a member of an Organized Crime Group
    3. A corporation whose directors include persons corresponding to a member of an Organized Crime Group
  3. ) When the Guest seeking accommodation does not submit the application specified in Article 2, Particular 1.
  4. ) When the Guest does not pay the deposit by the limit of the payment.
  5. ) When the Guest invites a visitor(s) into the guest room
  6. ) When the Guest seeking accommodation is clearly determined to be carrying an infectious disease;
  7. ) When violent demands and/or actions are made or carried out, or burdens that exceed the scope of reasonable requests have been made, in relation to accommodations.
  8. ) When the Hotel is unable to provide accommodation due to natural calamities and/or other causes of force majeure;
  9. ) When a person seeking Hotel accommodation is applicable to the provisions of Ishikawa Prefecture Hotel and Ryokan Management Law, Article 12.
  10. ) When the Guest does not observe prohibited actions such as smoking in bed, mischief relative to the firefighting equipment
  11. ) When the Guest does not observe other prohibitions of the Use Regulations stipulated by the Hotel

Registration

Article 7.
1. The Guest shall register the following particulars at the Front Desk of the Hotel on the day of accommodation:

  1. ) Name, address, phone number (or mobile phone number), sex, nationality and occupation of the Guest(s)
  2. ) (if the Guest is not of Japanese nationality): passport number, and port and date of entry into Japan
  3. ) Date of departure
  4. ) Other particulars deemed necessary by the Hotel.

Occupancy Hours of Guest Rooms

Article 8.
The Hotel has following classification for staying the Hotel;

  1. ) Monday ~ Wednesday (three days and two nights)
  2. ) Wednesday ~ Friday (three days and two nights)
  3. ) Friday ~ Monday (four days and three nights)

The Hotel may permit the Guest to occupy a room from 3:00 pm of the check-in day to 11:00 am on the check-out day. When the Guest stays the Hotel continuously within each unit, the Guest can use the room all day except the arrival day and departure day. However, the rooms are cleaned during 11:00 am to 3:00pm and our staff will enter the room. When th room is occupied continuously, bed making and cleaning are not conducted.

Observance of Hotel Regulations

Article 9.
The Guest shall observe the Hotel Regulations in the Hotel premises.

Payment of Accommodation Charges

Article 10.
1. The deposit of the accommodation charge is requested to pay to the bank account specified by the Hotel by the specified day. The transfer fee should be borne by the Guest.
2. Once accommodation facilities have been made available by the Hotel, the Accommodation Charges shall be paid even if the Guest voluntarily chooses not to utilize the facilities.

Liabilities of the Hotel

Article 11.
1. The Hotel shall compensate the Guest for any damage if the Hotel has caused such damage to the Guest in the course of its performance of, or by its non-fulfillment of, the Accommodation Contract and/or related agreements. However, this provision shall not apply in the event that such damage has been caused by a reason(s) not attributable to the Hotel.

Handling when unable to provide Contacted Rooms

Article 12.
1. The Hotel shall, when unable to provide the contracted rooms, arrange accommodation of the same standard elsewhere insofar as practicable with the consent of the Guest except due to unavoidable events beyond the Hotel’s control such as natural disasters
2. When arrangement of other accommodations cannot be made notwithstanding the provisions of the preceding paragraph, the Hotel shall pay the Guest Compensation equivalent to the cancellation charges. Through such payment, the Hotel shall be deemed to have fulfilled its obligation to compensate for the damages incurred by the Guest. However, if the Hotel’s inability to provide accommodation is not the result of a cause(s) attributable to the Hotel, the Hotel will not pay Compensation to the Guest.

Handling of Deposited Articles

Article 13.
1. The Hotel shall compensate the Guest for damages to articles (except money or valuables) the Guest has deposited at the Front Desk when said articles have been lost, broken or suffered other damage, except when the result of force majeure.
2. The Hotel shall not be responsible for any damages or loss to articles, money and valuables the Guest has brought into the Hotel and has not deposited at the Front Desk, unless loss or damage was caused intentionally or by gross negligence on the part of the Hotel.

Custody of Baggage or Belongings of the Guest

Article 14.
1. The Hotel shall not accept and keep the baggage of the Guest before the Guest arrives at the Hotel.
2. As a general rule, when a Guest’s baggage or belongings are found to be left behind after checkout, the Hotel will inform it of the owner and follow the instructions. If there are no instructions by the owner, the Hotel shall keep them for seven days including the day they were found and turn any valuables over to the nearest police station, and dispose of other articles.

Liability in regard to Parking

Article 15.
The Hotel has no parking lots for the Guests.

Liability of the Guest

Article 16.
The Guest shall compensate the Hotel for damage caused through the intention or negligence of the Guest.

Governing Law and Court of Jurisdiction

Article 17.
This contract is governed by and construed in accordance with the Japanese laws. Kanazawa District Court and Kanazawa Summary Court that has jurisdiction over the address of this Hotel shall be under the exclusive jurisdiction of the first instance with respect to a dispute or claim out of or relating to this Contract.

Rules for Usage

To ensure a safe and comfortable stay for its Guests, the Hotel has established the rules for usage below. Guests are requested to refrain from the following acts. Please be advised that guests failing to observe said rules may be denied the use of the rooms and facilities of the Hotel in accordance with the Article 6 of the Terms and Conditions for Accommodation Contract. In addition, we are not responsible for any accidents caused as a result of acts which are regulated in the rules.

  1. ) Use of heating or cooking equipment that may cause a fire in the room
  2. ) Smoking is prohibited in all places of the Hotel.
  3. ) This Hotel is located in the residential area. Shouting, singing loudly, arguments or other behavior that may disturb or inconvenience neighborhood.
  4. ) Bringing any of the following in the hotel:
    1. Animals, birds, insects and all kinds of pets
    2. Items that generate unpleasant or offensive odors that may inconvenience other guests
    3. Items in clearly excessive amounts
    4. Inflammable items such as gunpowder or volatile oil
    5. Firearms or swords without ownership permits
    6. Marihuana, narcotic drug, stimulant drug, etc.
  5. ) Gambling or acts contrary to public order in the hotel
  6. ) Inviting visitors into guest rooms and/or allowing them to use equipment or other items in guest rooms
  7. ) Selling products or holding a party in the guest rooms
  8. ) Transfer, processing or taking out of equipment, other items, etc. belonging to the hotel, or use of them for applications other than their intended purposes
  9. ) Installing extraneous items on buildings and equipment belonging to the Hotel or relocating such items in the hotel
  10. ) Use of photos taken in the Hotel for the purpose of sales without prior approval of the Hotel
  11. ) Use of shower in dead drunk
  12. ) We use a key system that the room doors are opened or closed by clicking (or tapping) the URL specified on the e-mail sent from the Hotel to the Guests via cell phone or smartphone. Accordingly, a person who does not have a cell phone or smartphone cannot use the system.
  13. ) This is an unattended hotel. In an emergency, contact the Hotel as shown on the hotel guidance provided in each room.
